Terms of Service

1. Service definition

BetterFlow ("the Platform," "we," "us," or "our") is an AI-powered project management and time tracking platform operated by Better Quality Assurance S.R.L., Cluj-Napoca, Romania. The Platform provides the following capabilities:

Time tracking and timesheet management
Project management and team assignments
Leave management and approval workflows
AI-powered productivity analytics
Client portal access
Automated reporting and exports
Third-party integrations (DeskTime, etc.)

2. Account & registration

To use BetterFlow, you must:

Be at least 16 years of age
Provide accurate and complete registration information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

Organizations control subscription plans and user access. Individual users cannot modify subscription settings without organizational authorization.

3. Subscription & Billing

Pricing Structure: BetterFlow operates on a tenant-based pricing model. Subscription fees are determined by the number of active users and selected modules.

Payment Terms: All subscription fees are non-refundable except as required by applicable law. Upon subscription expiration or termination, you have a 30-day grace period to export your data. After 30 days, data may be permanently deleted.

Free Trial: We offer a 30-day free trial with full feature access. No credit card is required for the trial. Trials automatically expire without charges unless you choose to subscribe.

4. Acceptable Use Policy

You agree not to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Upload malicious code or viruses
Attempt to gain unauthorized access to the Platform
Reverse engineer or decompile the Platform
Use the Platform for surveillance or monitoring beyond intended functionality
Resell or redistribute Platform access without authorization

5. Data Ownership & Privacy

Your Data: You retain all ownership rights to your data. We do not sell, rent, or share your data with third parties for marketing purposes.

Our License: You grant us a non-exclusive license to process your data solely to provide and improve the Platform services.

GDPR Compliance: We comply with EU General Data Protection Regulation (GDPR) requirements. See our Privacy Policy for detailed information on data handling.

Data Protection: We implement industry-standard security measures including TLS/SSL encryption, role-based access controls, and ISO 27001:2013 certified practices.

6. Third-Party Integrations

BetterFlow integrates with third-party services including DeskTime and future integrations (Jira, GitHub). Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for third-party service availability or data practices.

7. Service Level Agreement (SLA)

Uptime Target: We strive for 99.9% uptime excluding scheduled maintenance.

Support: Email support is available at [email protected]. We aim to respond within 24 business hours.

Backups: Daily encrypted backups are performed. Data recovery requests may incur additional fees.

8. Intellectual Property

BetterFlow and all related trademarks, logos, and content are the property of Better Quality Assurance S.R.L. You receive a non-exclusive, non-transferable license to use the Platform during your subscription term.

9. Warranties & Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. YOU USE THE PLATFORM AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Termination

You may cancel your subscription at any time. Upon termination, you have 30 days to export your data. We may terminate or suspend access for violations of these Terms. Fees paid are non-refundable except as required by law.

12. Modifications to Terms

We may modify these Terms with 30 days' notice for material changes. Continued use after changes constitutes acceptance. We will notify you via email of significant updates.

13. Governing Law & Dispute Resolution

These Terms are governed by Romanian law. Disputes shall be resolved in the courts of Cluj-Napoca, Romania. You waive any right to participate in class action lawsuits.
